These Terms and conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Chelsea Cottage on the Hill, you agree to be legally bound by these Terms and Conditions and accept that these Terms and Conditions may be modified or amended and posted on this website from time to time.

1.     A 50% deposit is required at the time of the order to secure the date of delivery.  Your initial deposit reserves your event date and is non-refundable.

2.     Payment to Chelsea Cottage on the Hill is accepted in cash, check, money order, CashApp, Venmo, or major credit card.

3.     Upon receipt of your order you will be emailed a copy of your invoice.  Please ensure all contact details, personal information, spelling of names, delivery/collection dates and times and any requested changes have been properly documented on your invoice. 

4.     Your final payment of the balance due will be collected upon delivery of cake.

5.     We are not responsible for any damage to the cake after setup/deli verity is complete.  You are responsible for providing an appropriate and secure table and environment for the cake (s). Cakes are heavy and require a study table and optimal room temperature of 75 degrees or below.

6.     If you or your representative elect to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves the possession of Chelsea Cottage on the Hill.

7.     On occasion, we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.

8.     Buttercream covered cakes, naked cakes and cupcakes should be refrigerated in the box in which they were delivered and removed from the fridge and brought to room temperature prior to serving. 

9.     Fondant covered cakes should not be refrigerated, but stored in a cool, preferably air-conditioned room, out of sunlight. Once cut, cakes should be stored in an airtight container or plastic wrap in the refrigerator. Sliced cake and cupcakes can also be stored in an airtight container and frozen for up to 3 months. 

10.  Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless or allergic reactions. Please inform us any any dietary restrictions or food allergies at the time you place your order.  Keto/Gluten Free/Sugar Free cakes will incur additional charges due to the expense of the ingredients.

11.  Delivery within five miles of Chelsea Cottage on the Hill is free.  Anything beyond the initial five miles will be calculated at $2.00 per mile each direction.

12.  Performance of this agreement is contingent upon the ability of Chelsea Cottage on the Hill to complete the agreement and is subject to labor disputes or strikes, weather, accidents, “acts of god,’ and other causes beyond our control.

By paying a deposit, the client accepts these Terms & Conditions
